Nursing home wins appeal

A NURSING home has won a battle to keep windows rejected by the borough council as not in keeping with the area.

The Planning Inspectorate ruled in favour of the owners of Silver Birch Lodge nursing home, in Bold Lane, Aughton, after its owners appealed against a council decision to refuse permission for UPVC windows which had been fitted on the front elevation of the building.

The nursing home owners had to apply for retrospective planning permission following complaints from two residents.

The council's planning department refused permission for the windows, claiming that they did not preserve the character Holt Green Conservation Area.

Planning inspector Nigel Harrison said in his report: “I have considered the representations made by two local residents stating that the windows are not in keeping with the old building or the character of the conservation area. Aughton Parish Council raised no objections. Whilst I note these comments, none is sufficient to alter the considerations that have led to my decision.

”Therefore, for the reasons given in the report and having regard to all other matters raised, I conclude that the appeal should be allowed.“

Although The Champion attempted to contact the building's owners for a comment on the Planning Inspectorate's decision they were unavailable before this week's edition went to press.

As a result of the appeal being upheld by the Planning Inspectorate the replacement windows will not have to be removed from the building.
