A TOP QC has told campaigners it is worth taking the case against the proposal to expand Whitemoss hazardous landfill site to a further hearing on Tuesday, February 16.

Now, though, the group face a race against time to raise £9,500 to pay for legal costs by this Friday (February 12).

David Wolfe QC of Matrix Chambers has recommended that the case against the tip expansion continues and says there are grounds for challenging the lawfulness of the Secretary of State's controversial decision to give the go-ahead to the hazardous waste site.

The February hearing is the last chance to ask the courts for permission to proceed with a Judicial Review.

If David Wolfe QC wins the argument at the hearing, permission will be given to proceed to a full Judicial Review, which can take up to a year. There is now a new legal team in place who are experienced in environmental work.

Arrow–No Whitemoss Landfill is appealing for donations.

Claire Robinson of Arrow–No Whitemoss Landfill said: “We raised £1,200 for the QC's opinion virtually overnight, such is the strength of local feeling against the tip.

”We now need to raise £9,500 within a week – which is a challenge.

“Over 3,000 residents objected to the proposal to expand Whitemoss landfill and we need everyone to donate to the legal fund if they can at

”All donations large and small are welcome, but £50 or £100 (more for those who can afford it) is a small investment to protect our homes and families from a hazardous waste tip.“
